Petitioners are apprehending their arrest in connection with Manatu P.S. Case No. 51 of 2017, corresponding to G.R. No. 2008 of 2017 for the offence under sections 306/34 of the Indian Penal Code.

Learned counsel for the petitioners has submitted that there is dispute in between mother of informant and mother of deceased and deceased took side of mother-in-law. Further, it has been submitted that no ingredient of section 306 of the Indian Penal Code and no where it is attributed that petitioners abetted the husband of the informant to commit suicide. Further, it has been submitted that petitioner no. 1 is lady.

Learned A.P.P opposed the prayer for anticipatory bail.

In the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner no. 1 namely, Shakila Bibi. Accordingly, the petitioner no. 1 is directed to surrender in the Court below within four weeks from the date of this order and in the event of her arrest or surrender the Court below shall enlarge the her on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand) with two sureties of the like amount each to the satisfaction of the court of Sri Rohit Kumar, learned J.M., Palamau at Daltonganj in connection with Manatu P.S. Case No. 51 of 2017, corresponding to G.R. No. 2008 of 2017 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

So far as the prayer for anticipatory bail on behalf of petitioner no. 2 namely Inayat Mian is concerned, there is specific allegation of assault on the husband of the informant, I am not inclined to grant him anticipatory bail. Accordingly, his prayer for anticipatory bail is hereby rejected.
