Petitioners are apprehending their arrest in connection with Barhi P.S. Case No. 77 of 2016, corresponding to G.R. No. 924 of 2016 for the offence under sections 147, 341, 323, 379, 325 and 307 of the Indian Penal Code.

Learned counsel for the petitioners has submitted that there is no specific allegation against these petitioners. Further, it has been submitted that the present case is counter-blast of Barhi P.S. Case No. 78 of 2016.

Learned A.P.P opposed the prayer for anticipatory bail.

In the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner no. 1 & 3 namely, Haritabh Kumar @ Haritam Yadav and Mahesh Yadav @ Mahesh Prasad Yadav and accordingly, they are directed to surrender in the Court below within four weeks from the date of this order and in the event of their arrest or surrender the Court below shall enlarge them on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand)each with two sureties of the like amount each to the satisfaction of the court of Sri Mayank Maliyaz, learned J.M, Ist Class, Hazaribag in connection with Barhi P.S. Case No. 77 of 2016, corresponding to G.R. No. 924 of 2016subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

So far as the prayer for anticipatory bail on behalf of petitioner no. 2 namely

Ravi Kumar, is concerned, there is specific allegation of assault against this petitioner, I am not inclined to grant him anticipatory bail. Accordingly, his prayer for anticipatory bail is hereby rejected.
