4/12.03.2018 Heard learned counsel appearing for the petitioner, learned counsel for the State and learned counsel for the informant, who oppose the prayer for bail of the petitioner.

The petitioner is an accused for allegedly committing offence punishable under Sections 420, 452, 323, 385, 386, 387, 511, 120(B), 504 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged by the informant that this petitioner, on the pretext of providing job, has taken money from several persons. It is further alleged that the petitioner neither provided job nor refunded the money to those persons from whom the money was taken.

It is admitted case that no money was taken by the informant. Learned counsel for the informant submits that he had introduced this petitioner with the beneficiaries and the beneficiaries had given money to this petitioner but the petitioner neither provided job nor refunded money and it is this informant, who has refunded money to the persons, who had given money to this petitioner. Now, the informant has lodged this case to recover the money, which he has paid to those persons.

Taking into consideration the aforesaid fact, I am inclined to enlarge the petitioner on bail. Accordingly, petitioner namely, Santosh Sahay @ Shahid Makbul is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of M.T.Topono, J.M.,1^st Class, Garhwa in connection with DandaP.S. Case No. 12 of 2017 [G.R. No. 669/2017].
