Rajesh Mandal Alias Raju Mandal Alias Rajesh Kr Mandal Vs The State Of Jharkhand

The petitioner is apprehending his arrest in connection with Ramgarh P.S. Case No. 02/2017, corresponding to G.R. No. 27/2017, the case registered under Sections 414 of the Indian Penal Code and section 33 of Indian Forest Act.

Learned counsel for the petitioner has submitted that petitioner is innocent and has committed no offence as alleged in the FIR and has been falsely implicated in this case.

From perusal of the records, it appears that petitioner in connivance with other persons had collected 150 quintals and 140 quintals of coal in two places with intention to black marketing.

Learned A.P.P opposed the prayer for bail.

Considering the fact and circumstances of the case, the above named petitioner is directed to surrender in the Court below within Four weeks from the date of this order and in the event of his arrest or surrender, the Court below shall enlarge the above named petitioner, on bail, on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of J.M. Ist Class, Dumka in connection with Ramgarh P.S. Case No. 02/2017, corresponding to G.R. No. 27/2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. , and subject to the further condition that petitioner shall deposit Rs. 20,500/- in the court below on or before his date of surrender and shall produce receipt of the same in the court below.

The aforesaid deposit shall be subject to the result of this case.
