The petitioners are apprehending their arrest in connection with O.C.R. Case No. 69 of 2013 for the offence under sections 41/42 and 76 of the Indian Forest Act and Transit Rules, 2004.

Learned counsel for the petitioners has submitted that the petitioners have been falsely implicated in this case. Further, it has been submitted that the other co-accused of this case namely, Beni Yadav and Nanhu Yadav @ Nanhoo Yadav have already been granted anticipatory bail by this Court in A.B.A. No. 4077 of 2016.

Learned A.P.P opposed the prayer for anticipatory bail.

Be that as it may, the above named petitioners are directed to surrender in the Court below within four weeks from the date of this order and in the event of their arrest or surrender the Court below shall enlarge the above named petitioners on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand) each, with two sureties of the like amount each to the satisfaction of the court of learned Chief Judicial Magistrate, Jamtara, in connection with O.C.R. Case No. 69 of 2013 , subject to the conditions as laid down under Section 438(2) of the Cr.P.C. The petitioners are directed to deposit Rs. 5,000/- each in the court below on the date of their surrender. However, deposition of aforesaid amount would be subject to the result of the case and will not prejudice the case of the petitioners during trial.
