The petitioner is apprehending his arrest in connection with Panki P.S. Case No. 111/2017, corresponding to E.C.case No. 05/2017, the case registered under Sections 420 of the Indian Penal Code and section 7 of E.C.Act.
Learned counsel for the petitioner has submitted that as per FIR 1575 litres of kerosene oil were seized from the house of the petitioner, but the signature of the petitioner on the seizure list was not obtained and he has been falsely implicated in this case. Hence, petitioner deserves anticipatory bail.
Learned A.P.P opposed the prayer for bail.
Considering the fact and circumstances of the case, the above named petitioner is directed to surrender in the Court below on or before 23.03.2018 and in the event of his arrest or surrender, the Court below shall enlarge the above named petitioner, on bail, on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Palamau, in connection with Panki P.S. Case No. 111/2017, corresponding to E.C.case No. 05/2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and subject to the further condition that petitioner shall deposit Rs. 9,000/- with the President/Secretary, District Bar Association, Daltonganj latest by 16.03.2018 and produce the receipt of the same in the court below. The aforesaid amount will be utilized for the welfare of the members of the District Bar Association.
