The impugned order suggests that Ashish Kr. Mehta, Deepak Kumar Mehta, Vikash Mehta and Ajay Mehta were apprehended and they have confessed their guilt implicating the petitioner in this case.

Counsel for the petitioner submits that the petitioner is not named in the FIR . He further submits that save and except confessional statement of coaccused, there is nothing against the petitioner and no recovery has been made from his possession. He lastly submits that the petitioner is in custody since 14.12.2017 and chargesheet has already been submitted in this case.

Learned A.P.P opposes the prayer for bail of the petitioner but has not controverted the aforesaid facts.

Taking into consideration the period of custody of the petitioner and nothing has been recovered from the possession of the petitioner, I am inclined to release him on bail. Accordingly, the petitioner, namely, Rohit Goswami @ Karu Goswami @ Ritesh Goswami @ Rohit Ritesh is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Koderma, in connection with Koderma P.S. Case No. 207 of 2017, corresponding to G.R. No. 1203 of 2017.
