Heard the counsel for the parties.
Learned A.P.P opposes the prayer for bail.
The petitioner is an accused for the offence punishable under Sections 147, 148, 149, 452, 379, 354, 427, 307 and 34 of the Indian Penal Code, in connection with Sadar P.S. Case No. 110/2014, corresponding to G.R. No. 539 of 2014, pending in the court of learned Chief Judicial Magistrate, Chatra.
Earlier the anticipatory bail application being ABA No. 6725 of 2017, preferred by the petitioner, was withdrawn by him. The petitioner again files this fresh application for grant of anticipatory bail without any grounds. Once the anticipatory bail is withdrawn by him, he should have surrendered before the court below.
In view of the earlier order dated 07.12.2017 passed in ABA No. 6725 of 2017, I am not inclined to entertain this application. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
