Heard learned counsel for the parties. Learned A.P.P. opposes the prayer for bail.
The petitioners are accused for allegedly committing an offence punishable under Sections 307/353/120(B)/34 IPC and Section 25(1-b)a/26/27/35 of the Arms Act.
One Binu Gope had given contract to Rakesh Verma to commit murder of one Ganga Sahu. Rakesh Verma planted three persons namely Jai Prakash Sukla, Vijendra Yadav and Dilip Verma. These three persons named these two petitioners for allegedly helping them. The name of these petitioners have transpired in the instant case on the basis of confessional statement of the coaccused who were arrested. Allegation against these petitioners is that they were helping other accused persons who were sent by Rakesh Verma. There is no allegation that these petitioner had supplied any money or any firearm nor they were arrested from the place of occurrence.
In view of the aforesaid facts of this case, I am inclined to allow these applications. Accordingly, the petitioners above named are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ranchi in connection with Dhurwa Police Station Case No. 240 of 2017 (G.R. No. 5601 of 2017).
