Learned A.P.P. appearing for the State opposes the prayer for bail of the petitioner.
Petitioner is an accused for allegedly committing the offence punishable under Section 376 of the Indian Penal Code in connection with Lalmatia Police Station Case No.89 of 2018 corresponding to G.R. No.1477 of 2018, pending in the Court of learned Judicial Magistrate 1st Class, Godda.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He submits that the petitioner is in custody since 25.09.2018.
After going through the records, I find that there is direct allegation of committing rape against the petitioner.
Keeping in view the direct allegation against the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, prayer for bail of the petitioner, abovenamed, in connection with Lalmatia Police Station Case No.89 of 2018 corresponding to G.R. No.1477 of 2018, pending in the Court of learned Judicial Magistrate 1st Class, Godda, is hereby rejected.
This application stands dismissed.
