The petitioner is an accused for the offence punishable under section 376 of the Indian Penal Code.
Both the informant and the petitioner are major. The informant alleges that she and the petitioner are living together as wife and husband. She states that because of their physical relationship she became pregnant. Later on, this petitioner had driven her out from the house stating that he is not the father of the child.
Taking into consideration the nature of allegation, I am inclined to release the petitioner on bail. Accordingly, the petitioner, namely, Kamlesh Murmu is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Dumka, in connection with Masalia P.S. Case No. 40 of 2018, corresponding to G.R. No. 818 of 2018.
