05/06.10.2017 Apprehending their arrest in connection with Complaint Case No.546 of 2014 instituted under Sections 420, 406, 323 of the Indian Penal Code and Section 4 of D.P. Act, the petitioners have moved this Court for grant of privileges of anticipatory bail.

Heard learned counsel appearing for the petitioners and learned Addl.P.P. appearing for the State. Though nlotice was issued to the opposite party no. 2 no one turns up on his behalf.

Learned counsel appearing for the petitioners submitted that the allegation against the petitioners is that the petitioners cheated the informant by taking Rs.80,000/- as Tilak and were further demanding Rs.71,000/- but later on they did not agree for the marriage of the petitioner No.2 with the sister of the complainant. It is submitted that the allegations against the petitioners are all false. It is further submitted that the petitioners are ready and willing to pay interim compensation of Rs.5,000/-(Rupees five thousand) each without prejudice to their defence in this case in favour of the complainant of this case namely- Manoj Rajbanshi. Hence, the petitioners may be given the privileges of anticipatory bail.

Learned Addl.P.P appearing for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions of learned counsels and the facts and circumstances stated above, I am inclined to grant privileges of anticipatory bail to the petitioners. Accordingly, the petitioners are directed to surrender in the Court of learned J.M., Palamu at Daltonganj within four weeks from today and in the event of their arrest or surrendering, they will be enlarged on bail on depositing demand draft of Rs.5,000/- (Rupees five thousand) each drawn in

favour of Manoj Rajbanshi as interim compensation for the complainant of this case namely – Manoj Rajbanshi and on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount to the satisfaction of learned J.M., Palamu at Daltonganj in connection with Complaint Case No.546 of 2014 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

In case the petitioners deposit the interim compensation amount of Rs.5,000/- (Rupees five thousand) each, the court below is directed to issue notice to the complainant of this case namely- Manoj Rajbanshi and on his identification, the court below shall release the aforesaid demand draft in his favour forthwith.
