03 / 05.10.2017 The Superintendent of Police, Giridih has submitted his explanation through which he has intimated that he has punished the Investigating Officer Faiz Rabbani, Sub Inspector of Police of Town P.S. with censor in his service book and the Investigating Officer of the case is present in the court today with the case diary.

Apprehending his arrest, the sole petitioner has moved this Court for grant of privilege of anticipatory bail in connection with Giridh Nagar P.S. Case No. 20 of 2015 (G. R. No. 291 of 2015 ) registered under Sections 420/34 of the Indian Penal Code.

Heard learned counsel appearing for the petitioner as well as learned Addl. PP for the State.

The learned counsel appearing for the petitioner submits that the allegations against the petitioner is that petitioner was an agent of Sarla Agro Industries Ltd. Company and he has falsely been implicated in this case. Drawing attention of the court to annexure 2, 3 and 4 of the brief, learned counsel further submitted that the Directors of the company has already been given privilege of anticipatory bail. Hence, the petitioner may be given the privilege of anticipatory bail.

The learned Addl. PP opposed the prayer for anticipatory bail. Considering the submissions of the counsels and the fact as discussed above, I am inclined to grant the privilege of anticipatory bail to the petitioner. Hence, in the event of his arrest by the police or surrender within a period of four weeks from the date of this order, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Giridih in connection with Giridih Nagar P.S. Case No. 20 of 2015 (G. R. No. 291 of 2015) subject to the conditions laid down under section 438 (2) Cr. P.C.
