04/ 05.10.17 The petitioners have been made accused in connection with Bharno P.S. case no. 38 of 2016 (G.R. No. 1000 of 2016) instituted under sections 376 (D) of the Indian Penal Code and under Section 4,8 and 12 of POCSO Act.

Heard learned counsel appearing for the petitioners as well as learned Addl. PP for the State.

Learned counsel appearing for the petitioners submitted that the allegation against the petitioner is that till today, during trial six witnesses have been examined including the prosecutrix and none of them have supported the case of the prosecution. The petitioners have been languishing in jail custody since 14.10.2016, hence, the petitioners deserve to be released on regular bail.

Learned Addl. P.P. opposed the prayer for regular bail but conceded that

Considering submissions of learned counsels and the facts as stated above, the petitioners are directed to enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge I, Gumla in connection with Bharno P.S. case no. 38 of 2016 (G.R. No. 1000 of 2016).
