05/06.10.2017 Apprehending his arrest in connection with Ramgarh P.S. Case No.334 of 2016 corresponding to G.R. No.1133 of 2016 instituted under Sections 427, 379, 384, 34 of the Indian Penal Code, the petitioner has moved this Court for grant of privileges of anticipatory bail.

Heard learned counsel appearing for the petitioner and learned Addl.P.P. appearing for the State.

Learned counsel appearing for the petitioner submitted that the petitioner is aged about 94 years. Drawing attention of this Court towards page-73 of the brief which is Annexure-2, learned counsel for the petitioner further submits that the petitioner had purchased the place of occurrence land and he is the owner of the same. The allegations against the petitioner are false. The dispute is of civil nature. Hence, the petitioner may be given the privileges of anticipatory bail.

Learned Addl.P.P appearing for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions of learned counsels and the facts and circumstances stated above, I am inclined to grant privileges of anticipatory bail to the petitioner. Accordingly, the petitioner is directed to surrender in the Court of learned Chief Judicial Magistrate, Ramgarh within four weeks from today and in the event of his arrest or surrendering, he will be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Ramgarh in

connection with Ramgarh P.S. Case No.334 of 2016 corresponding to G.R. No.1133 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
