The petitioner is apprehending their arrest in connection with C/1 Case No. 4053 of 2010 for the offence under sections 420, 406, 34 of the Indian Penal Code.

The learned counsel for the petitioner has submitted that earlier the petitioner had moved anticipatory bail application being A.B.A. No. 2832 of 2011 before this Court was was rejected thereafter the petitioner moved W.P.(Cr.) No. 31 of 2012 before this Court which was dismissed thereafter, the petitioner move A.B.A. No. 4629 of 2015 which was also rejected. Thereafter, the petitioner moved Cr.M.P. No. 97 of 2017 before this Court which was allowed.

Learned counsel for the petitioner has further submitted that the petitioner has been falsely implicated in this case. Further, it has been submitted that the dispute between the parties has been settled and the case has been compromised.

Learned A.P.P opposed the prayer for anticipatory bail.

In the facts and circumstances of the case, the above named petitioner is directed to surrender in the Court below within five weeks from the date of this order and in the event of his arrest or surrender the Court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand), with two sureties of the like amount each to the satisfaction of the court of Sri Vishal Gaurav, learned J.M. Ist Class, Jamshedpur in connection with C/1 Case No. 4053 of 2010, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. It is further directed that petitioner will deposit Rs. 11,000/- before the Secretary, District Bar Association, Civil Court, Jamshedpur and submit the receipt of deposition of aforesaid amount to the trial court on the date of surrender.

Let a copy of this order be sent to the trial court as well as to the Secretary,
