The petitioners are apprehending their arrest in connection with Barlanga P.S. Case No. 24 of 2016, corresponding to G.R. No. 1158 of 2016 for the offence registered under sections 384, 385, 387, 34 of the Indian Penal Code.

The learned counsel for the petitioner has submitted that the petitioners have been falsely implicated in this case. Further, it has been submitted that there is general and vague allegation against the petitioners. Now both the parties have settled and compromised the matter outside the court.

Learned A.P.P opposed the prayer for anticipatory bail and filed counter-affidavit.

In the facts and circumstances of the case, I am inclined to granted anticipatory bail to the petitioner nos. 2 to 5 and accordingly, the petitioners namely, Vimal Gupta @ Bimal Gupta, Nirmal Prajapati, Matru Gupta and Maya Sao @ Bhaya Sao are directed to surrender in the Court below within four weeks from the date of this order and in the event of their arrest or surrender the Court below shall enlarge the above named petitioners on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand)each, with two sureties of the like amount each to the satisfaction of the court of Sri Rajesh Srivastav, learned J.M, Ramgarh, in connection with Barlanga P.S. Case No. 24 of 2016, corresponding to G.R. No. 1158 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

So far the prayer for anticipatory bail on behalf of the petitioner no. 1-Keshri Gupta is concerned, as this petitioner has criminal antecedent, I am not inclined to grant him anticipatory bail. Accordingly, his prayer for anticipatory bail is hereby rejected.
