The petitioners are apprehending their arrest in connection with the case registered under Sections 406/409/419/420/467/468/471 of the Indian Penal Code.

Brief facts of the case is that the petitioner was assistant of Co-operative bank and in a criminal conspiracy and for their own benefit have shown payment of illegal amount against the banking rules and embezzled the same. It is alleged that to cover up their misdeeds, the bank documents were found fudged and the dispatch of inquiry reports was also delayed. It is alleged that the petitioner have defalcated a sum of Rs. Two lacs from the said bank.

Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case only on the basis of suspicion because he has only passed the voucher with respect to payment after passing of the Branch Manager. It is further submitted that he has retired from the said bank.

Learned counsel for the State has filed the counter affidavit and opposed the prayer for bail.

Be that as it may, I am inclined to admit the petitioner on anticipatory bail. The petitioner is directed to surrender in the court below within six weeks and in the event of his arrest or surrender, the court below shall release him on bail on his furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like

amount each to the satisfaction of learned SDJM, Deoghar, in connection with Sarwan P.S. Case No.25/2016, corresponding to G.R.No.293/2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C. Subject to further condition is that the petitioner shall deposit Rs. 75,000/- before the court below on the date of surrender.

The aforesaid deposit is subject to the result of the case.
