The petitioner is apprehending his arrest in connection with Barhi P.S. Case No. 232 of 2016, corresponding to G.R. No. 2620 of 2016, for the offence under sections 467, 468, 471 and 420 of the Indian Penal Code.
It is alleged that the petitioner was appointed as Assistant Teacher in Middle School, Barso, Barhi and after enquiry his intermediate certificate was found forged and he was terminated from his service.
It appears that under order dated 28.02.2017, counsel for the petitioner was directed to take instruction as to how many months and years, the petitioner has worked as Assistant Teacher and what was his monthly salary and pursuant to that order, counsel for the petitioner has filed supplementary affidavit stating therein that petitioner has joined the said post on 13.01.2016 and thereafter vide office order bearing Memo No. 2508 dated 31.08.2016, petitioner was terminated from the service. Thus, the petitioner has worked on the post of Assistant Teacher for about eight months only and during the aforesaid period, nothing has been paid as salary to the petitioner.
In the facts and circumstances of the case, the above named petitioner is directed to surrender in the Court below within five weeks from the date of this order and in the event of his arrest or surrender the Court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand), with two sureties of the like amount each to the satisfaction of the court of learned C.J.M, Hazaribag, in connection with Barhi P.S. Case No. 232 of 2016, corresponding to G.R. No. 2620 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. The petitioner is directed to deposit cost of Rs. 10,000/-
before the before the court below on the date of his surrender. However, deposition of
aforesaid amount would be subject to result of the case.
