04/ 07.01.2016 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner is apprehending his arrest in connection with Jamtara (Mihijam) P.S. Case No. 273 of 2015 corresponding to G.R. Case No. 778 of 2015, for the alleged offence under Sections 341, 323, 504, 354 / 34 of the Indian Penal Code.
There is allegation against the petitioner and the other co-accused persons of assaulting the informant. There is also allegation against the petitioner of pulling the saree of the informant. It is apparent from the FIR that both the parties are the members of the same family.
In the facts of this case, I am inclined to grant anticipatory bail to the petitioner, Ajay Rajak. Accordingly, it is directed that in the event of his surrender / arrest, the petitioner, named above, shall be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand), with two sureties of the like amount each, to the satisfaction of learned S.D.J.M., Jamtara, in connection with Jamtara (Mihijam) P.S. Case No. 273 of 2015 corresponding to G.R. Case No. 778 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
