4/ 06.01.2016 Heard learned counsel for the petitioner and learned A.P.P. for the Prosecution.
The petitioner has been made accused for the offence under Sections 364, 395 and 412 of the Indian Penal Code, in connection with Mango (M) P.S. Case No. 296 of 2014 corresponding to G.R. No. 1707 of 2014, S.T. No. 116 of 2015.
The FIR shows that the informant, who is driver and owner of the truck, and his nephew, who were in the truck, were abducted by the accused persons along the truck and in course of offence, the truck met with an accident. The petitioner was apprehended along with victims in the truck.
Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case and in similar circumstance, other co-accused has been granted bail.
Learned counsel for the State has opposed the prayer for bail.
In the facts of this case, I am not inclined to enlarge the petitioner, Suraj Kumar, on bail. Accordingly, his prayer for bail is rejected.
