It is submitted by learned counsel for the petitioners that during pendency of this anticipatory bail application, petitioner no. 2 Ranjeet Yadav has been arrested, so he wants to withdrawn the anticipatory bail application of petitioner no. 2.

2. Prayer is allowed.

3. Hence, the anticipatory bail application on behalf of petitioner no. 2 Ranjeet Yadav is dismissed as not pressed.

4. The petitioner Shailendra Singh is apprehending his arrest in connection with Barwadih P.S. Case No. 20 of 2016, corresponding to G.R. No. 231 of 2016, registered under Section 379 of the I.P.C. and 4 / 54 of the Jharkhand Minor Mineral Concession Rules, 2004, pending in the court of learned Sub Divisional Judicial Magistrate, Latehar.

The prosecution case is that one complaint was given by Triloki Singh addressed to Mining Officer, Latehar alleging therein that Shailendra Singh (petitioner) was running a brick kiln excavating soil from the field of Triloki Singh and constructing bricks without getting licence from the District Mining Officer. On the basis of these allegations, the instant case has been lodged.

It is submitted by learned counsel for the petitioner that a report was called for from the Circle Amin and the report was submitted by the Amin on 13.03.2016 before the Circle Officer, Barwadih, who has submitted his report that under Khata No. 6, Plot No. 173, having area of 0.25 decimals, earth cutting was done 14 years prior to date of allegation.

5. Be that as it may, I am inclined to admit the petitioner no. 1 namely Shailendra Singh, on bail. Petitioner Shailendra Singh is directed to surrender in the court below within two weeks from the date of this order and in the event of his arrest or surrender the court below shall enlarge the above

named petitioner on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand), with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Latehar, in connection with Barwadih P.S. Case No. 20 of 2016, corresponding to G.R. No. 231 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
