Heard learned counsel for the petitioner as well as learned counsel for the State.

2. The petitioner is apprehending his arrest in connection with Seraikella P.S. Case No. 66 of 2016, corresponding to G.R. No. 386 of 2016, registered under Sections 290 of the I.P.C. read with Section 47(a) of Excise Act, pending in the court of learned Chief Judicial Magistrate, Seraikella.

3. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. It is further submitted that neither the petitioner was arrested on the spot nor anything has been recovered from conscious possession of petitioner.

4. Learned APP has filed the counter affidavit and submitted that illicit Mahua wine has been recovered from the house of the petitioner.

5. Be that as it may, I am inclined to admit the petitioner, above named on bail. The petitioner is directed to surrender in the court below within two weeks from the date of this order and in the event of his arrest or surrender the court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand), with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Seraikella, in connection with Seraikella P.S. Case No. 66 of 2016, corresponding to G.R. No. 386 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C., subject to the further condition that on the date of surrender petitioner shall deposit Rs. 2,000/- in the trial court.
