Heard learned counsel for the petitioners and learned counsel for the State.
Petitioners have been made an accused for the offence registered under Sections 147, 148, 149, 341, 323, 324, 307, 302 of the Indian Penal Code.
The prosecution case is that the informant namely, Dasrath Sah, aged about 60 years gave his fardbeyan on 19.02.2016 recorded by S.I J.P. Yadav alleging therein that on previous night i.e. on 18.02.2016 at about 7:30 PM his neighbour Jagarnath Sah aged about 25 years near his house climbed on a electric poll for repairing his electric connection and during repairing the electric supply wire of informant was disconnected. Thereafter his on Binod Sah told to accused Jagarnath Sah for disconnection then the talk converted into hot exchange and raising alarm, in the meant time F.I.R named accused persons including these petitioners armed with Axe, Danda and other deadly weapons came there and started assaulting with intention to kill the son of the informant and he received grievous injury when the informant and his brothers came to rescue, the accused persons also assaulted them and injured Nepal Sah received grievous injury and his treatment is going on in Saddar Hospital and due to grievous injury his son Vinod Sah died at the spot.
Learned counsel for the petitioners has submitted that petitioner No.1 is in custody since 02.05.2016 and petitioner No.2 and 3 are in custody since 22.02.2016 in B.A. No. 5101 of 2016 and petitioner, Jagarnath Sah @ Jagarnath Prasad Sah @ Jagarnath Pd. Sah is in custody
