The petitioner has been made accused for the offence under Sections 302 / 34 of the Indian Penal Code, in connection with S.T. No. 40 of 2016, arising out of Hariharpur P.S. Case No. 18 of 2015 corresponding to G.R. No. 1035 of 2015.
The case relates to murder of the brother of the informant and there is specific allegation against the named co-accused to have assaulted the deceased, causing his death at the spot. It is, however, alleged that the unknown accused persons had hurled bomb when they were being chased, in which, the officer-in-charge of Hariharpur Police Station had sustained some injuries. The present case appears to have been lodged only for the offence under Sections 302 / 34 of the Indian Penal Code. The petitioner is not named in the FIR.
In the facts of this case, I am inclined to enlarge the petitioner, Md. Mumtaj, on bail. Accordingly, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand), with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-VI, Dhanbad, in connection with S.T. No. 40 of 2016, arising out of Hariharpur P.S. Case No. 18 of 2015 corresponding to G.R. No. 1035 of 2015.
