Petitioner has been made accused for the offence under Sections 409, 420 / 34 of the Indian Penal Code, in connection with Hiranpur P.S. Case No.05 of 2016, corresponding to G.R. No.38 of 2016.

From the FIR and the impugned order, it appears that the case relates to fraudulent withdrawal of money in connection with renovation of pond under the MANREGA Scheme, in which Rs.8,83,380/- was withdrawn, but the work was done only to the tune of Rs.5,63,714/-. There is allegation of misappropriation of the amount of Rs.3,82,366/- against the accused persons, including the Block Panchyat Raj Officer, concerned Junior Engineer and the petitioner, being the Rojgar Sevak.

In the facts and circumstances of the case, I am inclined to release the petitioner on bail. Accordingly, the petitioner Santosh Kumar Murmu is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of Sri M.C. Niranjan, learned Judicial Magistrate, Pakur, or his successor, in connection with Hiranpur P.S. Case No.05 of 2016, corresponding to G.R. No.38 of 2016.
