02/06.05.2016 Mr. P. K. Chatterjee, learned counsel appearing for the petitioner, submits that the petitioner is the elder brother of the main accused namely Madan Yadav who is said to have enticed away the daughter of the informant and it has been submitted that both victim as well as the younger brother of the petitioner are still traceless.
Mr. Shekhar Sinha, learned A.P.P. is directed to obtain the case diary and shall file counter affidavit within a period of three weeks.
In the meantime, if the process under Sections 82 and 83 of the Cr.p.C. has not been issued, the same shall not be issued in connection with Dhanbad P. S. Case No. 198 of 2016 corresponding to G. R. No. 722 of 2016 pending in the court of learned Chief Judicial Magistrate, Dhanbad.
