The petitioner is an accused in a case registered under Sections 399, 402 and 414 of the Indian Penal Code and Sections 3/4 of the Explosive Substance Act.
It reveals from the first information report that place of occurrence was raided by the police and two persons were apprehended, whereas companion accused have succeeded to flee away. It is alleged that the accused persons had assembled with an intention to commit dacoity and they were making preparation for that.
It is submitted that the petitioner has been implicated in this case on the basis of disclosure made by the apprehended accused. Nothing incriminating has been recovered from his possession and he has been in jail custody since 10th November 2014.
Counsel for the State has opposed the petitioner's prayer for bail.
Considering the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount, each, to the satisfaction of learned Additional Sessions Judge-VIII, Hazaribagh, in connection with S.T. No.124(A) of 2003, arising out of Barkagaon P.S. Case No.25 of 2002, corresponding to G.R. no.743 of 2002.
