Heard learned counsel for the parties.
It reveals from the F.I.R. that Musena Khatoon was subjected to torture and treated with cruelty for want of more dowry demanded in terms of motorcycle. Lastly she has been done to death.
It is submitted that the police, after due investigation, submitted chargesheet only against accused Mujibul Ansari. The petitioner and his wife Maimun Khatoon have not been sent up for trial but the learned Magistrate has taken cognizance. Maimun Khatoon having similar allegation has been granted anticipatory bail by a Bench of this Court vide A.B.A. No.2390 of 2014. The petitioner happens to be father-in-law.
Learned counsel appearing for the State has opposed the prayer for bail. It is apparent from the case diary that the petitioner was not living with his son and therefore, the I.O. has submitted Final Form against him.
In the circumstances, above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court of learned S.D.J.M., Lohardaga in connection with Kairo P.S. Case No.02 of 2013 corresponding to G.R. Case No.34 of 2013.
