The petitioner is an accused in a case registered under Sections 147, 148, 149, 353, 307, 324, 326, 120B of the Indian Penal Code, Sections 3/4 of Explosive Substance Act, Sections 10/13 of U.A.P. Act and Section 17 of Criminal Law Amendment Act.
It reveals from the written report that land mine was exploded by M.C.C. Extremists, causing injury to police personnel. Accused persons also showered bullet on police party. In course of occurrence, the informant and other witnesses overheard the names of accused persons, including name of the present petitioner, while they were addressing to each other.
It is submitted that similarly situated co-accusedDalchand Mahto and Loknath Mahto and Naresh Mahto @ Naresh Kumar Mahto have been granted bail by this Court vide B.A. No.5814 of 2014 and B.A. No.4313 of 2014, respectively.
Counsel for the State has opposed the petitioner's prayer for bail and submitted that some of the villagers have named the petitioner and other accused persons.
Since similarly situated other co-accused are enjoying the privilege of bail, the petitioner, above named, is also directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount, each, to the satisfaction of learned Sub Divisional Judicial Magistrate, Bermo at Tenughat, in connection with Mahuatand P.S. Case No.05 of 2013, corresponding to G.R. No.95 of 2013.
