The petitioner is an accused in a case registered under Sections 147, 148, 149, 341, 323, 324 and 307 of the Indian Penal Code and Section 27 of the Arms Act.
It reveals from the first information report that the petitioner and his associates caused assault to Shiv Lal and Ram Lal. There is allegation that the petitioner opened fire from his pistol causing injury to Shiv Lal. This fact finds support from the statement of the victim-Shiv Lal.
It is submitted that the petitioner has been falsely implicated in this case. Co-accused Swapan Mandal has been granted bail by this Court.
Counsel for the State has opposed the petitioner's prayer for bail.
Since there is direct allegation of causing injury to Shiv Lal, I do not feel inclined to release the petitioner, above named, on bail in connection with Borio (J) P.S. Case No.51 of 2014, corresponding to G.R. No.116 of 2014.
Accordingly, petitioner's prayer for bail stands rejected.
