The petitioner has been made an accused in connection with Basia P.S. Case No. 4 of 2014 registered under Sections 147/148/149/302/323 of the Indian Penal Code, Section 27 of the Arms Act and Section 17 of the Criminal Law Amendment Act.
It has been submitted by the learned counsel for the petitioner that the first information report was instituted against the unknown-persons and subsequently on the basis of alleged confessional statement given by this petitioner he has been implicated in the present case. It has further been submitted that petitioner is in custody since 28.01.2015. Save and except the said confessional statement there is nothing on record to connect the petitioner.
Learned counsel for the State opposes the prayer for bail and submits that the petitioner was remanded in this case from other case i.e Basia P.S Case No. 41 of 2014 and that he has got criminal antecedent.
Regard being had to the facts that there is no incriminating situation to connect the petitioner with the commission of the offence, the petitioner Lalu Lohra is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-III, Gumla in connection with Basia P. S. Case No.4 of 2014 corresponding to G.R No. 120 of 2014 (S.T. No. 218 of 2015).
