3/ 06.07.2015. Heard learned counsel for the petitioner and the learned counsel for the State as also learned counsel for the informant.
The petitioner has been made accused in connection with Chandrapura P.S. Case No. 155 of 2014, corresponding to G.R. No. 1093 of 2014, S.T. No. 295 of 2014, for the offence under Sections 304-B / 34 of the Indian Penal Code.
The petitioner is the mother-in-law of the deceased and there is allegation against the accused persons, including the petitioner, to have subjected the deceased to cruelty and torture for demand of dowry and to have committed her dowry death within three months of her marriage, by burning her. The F.I.R. also show that the deceased while she was injured had also informed her father that the petitioner and the other in-laws had burnt her.
Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case and in the similar circumstance the brother-in-law of the deceased has been granted bail.
Learned counsel for the State as also learned counsel for the informant have opposed the prayer for bail.
In the facts of this case, I am not inclined to release the petitioner, being the mother-in-law, on bail. Accordingly, the prayer for bail of the petitioner Asha Devi, is hereby rejected.
