Heard learned counsel for the petitioners and learned counsel for
the State.
The petitioners have been made accused in connection with Amrapara P.S case No. 56 of 2014 corresponding to G.R No.782 of 2014, for the offence under Sections 302, 120-B, 34 of the Indian Penal Code.
The case relates to murder of the husband of the informant and the informant is an eyewitness to the occurrence. It is alleged that the culprits who had concealed their faces, had committed murder of the deceased. The petitioners have been made accused on the basis of suspicion, due to previous enmity .
Learned counsel for the petitioners has submitted that the petitioners have been falsely implicated in this case due to previous enmity and has accordingly, prayed for bail.
Learned counsel for the State has opposed the prayer for bail, submitting that the witnesses have stated about the previous enmity between the parties, as also the threatening given by the petitioners.
The impugned order also shows that there is only strong suspicion against the petitioners.
In the facts and circumstances of the case, I am inclined to enlarge the petitioners, Kubraj Murmu and Matal Murmu, on bail. Accordingly, the petitioners, named above, are directed to be released on bail, on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each, to the satisfaction of Sri D.C. Awasthi, learned Judicial Magistrate, 1st class, Pakur, or his successor, in connection with Amrapara P.S case No. 56 of 2014 corresponding to G.R No.782 of 2014.
