04/02.07.2014 Heard the learned counsel appearing for the parties and perused the documents on record.

The learned counsel appearing for the applicant submits that the applicant is apprehending his arrest in C.I. Case No. 16 of 2012, instituted under Sections 41, 42 of the Indian Forest Act.

The learned counsel for the applicant submits that, the applicant is the owner of the pick-up van bearing no. JH-07D-2450 which was allegedly carrying 'Sisham' and 'Sal' woods. It is submitted that one Laxmi Narayan Sahu, hired the said pick-up van from the applicant and on 30.11.2012 the said pick-up van was stolen. The said Laxmi Narayan Sahu is the suspect who got the van stolen. The alleged date of occurrence is 26.11.2012. It is submitted that the report was submitted for the offence under Section 41 & 42 of the Indian Forest Act and maximum sentence for the offence as alleged is six months only.

The learned A.P.P. appears and opposes the prayer for grant of anticipatory bail.

In the facts and circumstances of the case, in the event of arrest of the applicant or if the applicant surrenders before the trial court within a period of four weeks from today, the applicant namely,

Shashi Bhushan Sahu would be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gumla in C.I. Case No. 16 of 2012.
