02/ 04.12.2014 Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners are apprehending their arrests in connection with Borio (J) P.S. Case No. 300 of 2013 corresponding to G.R. No. 657 of 2013, for the alleged offence under Section 7 of the Essential Commodities Act.
The case relates to recovery of 100 ltrs. of kerosene oil. It was informed by the driver of the Auto Rikshaw, form which, the recovery was made that the said kerosene oil was loaded on the Auto Rikshaw by the other co-accused persons, who were the President and her husband of one Maa Bhagwati Self Help Organisation. The driver did not make any allegation against these petitioners. However, the petitioners have been made accused in this case, being the Secretary and Accountant of the said Organisation.
In the facts of the case, I am inclined to grant anticipatory bail to the petitioners, Mosstt. Gangia and Lila Devi, being ladies. Accordingly, it is directed that in the event of their surrender / arrest, the petitioners, named above, shall be released on bail, on furnishing bail bonds of Rs. 10,000/- (ten thousand) each, with two sureties of the like amount each, to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sahibganj, in connection with Borio (J) P.S. Case No. 300 of 2013 corresponding to G.R. No. 657 of 2013, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
