2/ 04.12.2014 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner is apprehending his arrest in connection with Namkum P.S. Case No. 136 of 2014 corresponding to G.R. No. 3850 of 2014, for the alleged offences under Sections 414, 467, 468, 471, 420, 120-B of the Indian Penal Code, Section 11 of the Prevention of Cruelty to Animals Act, 1960 and Section 4 of the Bihar/Jharkhand Preservation & Improvement of Animals Act, 1955.
Two trucks were apprehended by the police loaded with cattle and co-accused was apprehended by the police.
Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case only being the owner of one of the trucks. It is submitted that the apprehended co-accused persons have been granted bail by order dated 22.9.2014 in B.A. No. 6510 of 2014, as it was found that receipts with respect to cattle were issued by Sisai Bazar Samitee and the cattle were purchased one and there was no theft report. Learned counsel has brought on record the receipts issued by Bazar Samitee, Sisai (Gumla).
Learned counsel for the State has opposed the prayer for bail.
In the facts of this case, I am inclined to grant anticipatory bail to petitioner, Jabbar Khan. Accordingly, it is directed that in the event of his surrender / arrest, the petitioner, named above, shall be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand), with two sureties of the like amount each, to the satisfaction of Sri Rajiv Ranjan, learned Judicial Magistrate 1st Class, Ranchi, or his successor, in connection with Namkum P.S. Case No. 136 of 2014 corresponding to G.R. No. 3850 of 2014, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
