02/04.04.2013. Anticipatory bail application filed by Bahadur Mahtha and Guthar Mahtha is moved by Sri. Tarun Kr. Sinha , learned counsel for the petitioner and opposed by Sri. Awanikant Prasad , Addl P.P. for the State.

FIR reveals that there is general and omnibus allegations of assault against all accused persons including these petitioners. Injury report incorporated in the case diary shows that the son of informant had received simple injury. No specific overtact alleged against the petitioners.

Considering the aforesaid fact and circumstance, I allow this application and direct the petitioners, named above, to surrender in the court below by 12/04/2013. If petitioners surrender by that time, the court below is directed to enlarge the petitioners, named above, on bail, on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of J.M. 1st Class, Giridih in connection with Deori P.S. case no.70/2012, corresponding to G.R.No.1197/2012, subject to the condition as laid down under section 438(2) of the Cr. P.C.
