2/03.04.2013 Anticipatory bail application filed by petitioner Ashok Prasad Mehta is moved by Sri Awnish Shankar, learned counsel for the petitioner and opposed by Sri T.N.Verma, learned Additional PP. for the State.

It appears that co-accused Sunita Devi, Bimla Devi and Ganita Devi have been granted anticipatory bail by a Bench of this Court vide order dated 12.02.2013 in A.B.A. No. 4793 of 2012. It is also an admitted position that other two co-accused namely Binod Prasad Mehta and Bindeshwar Prasad Mehta have been granted regular bail. Allegation against petitioner is similar to aforesaid coaccused.

Considering the aforesaid facts and circumstances, I allow this anticipatory bail application and direct the petitioner to surrender in the court below on or before 11^th of April 2013 and in the event of his surrender, the learned court below is directed to enlarge him on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Hazaribagh in connection with Ichak P.S. Case No. 108 of 2012, corresponding to G.R. No. 1994 of 2012, subject to the condition as laid down under section 438(2) of the Cr. P.C.
