Anticipatory bail application filed by Rajesh Yadav, is moved by Smt Rashmi Kumar, learned counsel for the petitioner and opposed by Sri Tapas Roy, learned Additional P.P. for the State.
From perusal of first information report, it manifest that the alleged liquor recovered from the house of coaccused Raj Kumar Sao. Petitioner implicated in this case because after seeing the police party, he also fled away along with aforesaid co-accused.
Considering the aforesaid facts and circumstances, I allow this anticipatory bail application and direct petitioner to surrender in the court below on or before 11.04.2013 and in the event of his surrender, the learned court below is directed to enlarge the petitioner, above named, on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Koderma, in connection with Jainagar (Telaiya Dam O.P.) P.S. Case No. 33 of 2012 corresponding to G.R. No. 214 of 2012, subject to the condition as laid down under section 438(2) of the Cr.P.C.
