Anticipatory bail application filed by Sanjeev Kumar Keshari, is moved by Sri P.P.N. Roy, learned senior counsel for the petitioner and opposed by Sri S. Mahto, learned Additional P.P. for the State.
It appears that other co-accused namely Shakuntala Devi, Juli Kumari, Swati Kumari and Babli Devi have been granted anticipatory bail by this Court vide order dated 11.02.2013 in A.B.A. No. 3888 of 2012 on taking into account that the deceased died due to chronic anemia and hypo protinimia following chronic diseases. The case of petitioner stand on similar footing.
Considering the aforesaid facts and circumstances, I allow this anticipatory bail application and direct petitioner to surrender in the court below on or before 12.04.2013 and in the event of his surrender, the learned court below is directed to enlarge the petitioner, above named, on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Civil Judge-cum-Chief Judicial Magistrate, Chatra, in connection with Chatra (Sadar) P.S. Case No. 102 of 2012 corresponding to G.R. No. 486 of 2012, subject to the condition as laid down under section 438(2) of the Cr.P.C.
