This petition has been filed way back in February, 2005 and the
petitioner has sought following reliefs:-
a) to issue writ of certiorari quashing the condition No. 3 of the important terms and conditions and note appended to tender form after holding the same as ultra vires of Section 3 and Section 8 of CST Act b) To issue Writ of mandamus directing the respondent No. 2 to accept “C” forms and not to collect more than 4% tax as provided under the provisions of the Central Sales Tax Act. c) To give such other relief and to pass such other order or direction which is/are considered appropriate by the Hon’ble High court on the facts and circumstances of the case and d) To award the cost of this writ petition.
With a passage of time, the reliefs claimed appear to have become
infructuous. The petitioner is also absent which shows that he has lost interest. As
such, the present petition is dismissed.
