Gurvinder Singh Vs the Jammmu and Kasmir Bank Ltd.and Ors.

Through the medium of instant petition, the petitioner has challenged order dated 23.03.2015 passed by the learned Additional District Judge (Bank cases), Jammu whereby the salary account of the petitioner has been attached in terms of the provisions contained in Order 38 Rule 5 CPC.

I have heard learned counsel for the parties and perused the impugned order.

A perusal of impugned order reveals that the same has been passed subject to filing of objections by the petitioner herein and, therefore, the petitioner is free to approach the trial Court to seek variation/vacation of the said order and to participate in the proceedings before it.

In view of the above, the petition is disposed of with a liberty to the petitioner to approach the trial Court to seek variation/vacation of the impugned order. The petitioner is also at liberty to move an appropriate application for participating in the proceedings in the suit which is stated to be

pending before the trial Court. In case such applications are filed by the petitioner before the trial Court, the same shall be considered by the trial Court

on their own merits in accordance with law with utmost dispatch.
