With the consent of parties, the judgment dated 22.03.1999, rendered in Civil Appeal No. 133-S/13 of 1995 is quashed and set aside. The matter is remanded back to the learned District Judge, Shimla, with a direction to decide the same afresh, within a period of six months from today. In order to avoid delay, the parties shall make themselves available before the Court of learned District Judge, Shimla on 31st December, 2010. The Registry is directed to return the records to the learned District Judge, Shimla within a period of 7 days.
