Heard Mr. D. K. Kotoky, learned counsel for the petitioner and Mr. D. Gogoi, learned Standing counsel for the respondent Assam Cooperative Apex Bank Limited.

Matter relates to non-compliance and willful disobedience of the order dated 16.07.2018, passed in WP(C) No.4416/2018.

In the order dated 16.07.2018, the Court directed the respondent Assam Cooperative Apex Bank Limited to consider the appeal of the petitioner dated 12.08.2013 by the Board of Directors of the said Bank in its next meeting and to dispose of the said appeal of the

petitioner at the earliest, if not already decided in the meantime.

Mr. D. Gogoi, learned Standing counsel for the respondent Assam Cooperative Apex Bank Limited placed a communication before the Court to show that the Board of Directors of the Bank concerned in its meeting held on 28.08.2018 vide Agenda No.5 and Resolution No.5 rejected the said appeal of the petitioner filed on 12.08.2013 approving the order of his dismissal dated 29.07.2013 issued by the concerned Disciplinary Authority i.e., the Managing Director of the Bank as the Board did not find any new material to consider relaxation of punishment imposed upon the petitioner by the said order dated 29.07.2013 and the Board of the Bank upheld the earlier decision of the Bank taken against the petitioner.

As the respondents in the Assam Cooperative Apex Bank Limited have complied with the order dated 16.07.2018, passed in WP(C) No. 4416/2018, there is no such contempt on the part of the respondent/contemnor and accordingly this contempt petitioner being devoid of merit stands rejected.

A copy of the instruction placed before the Court by Mr. D. Gogoi, learned Standing counsel for the respondent Assam Cooperative Apex Bank Limited be kept as part of the record.

However, it is made clear that the respondent shall communicate the decision of the Board about the rejection of his appeal to the petitioner forthwith.
