Heard the learned counsel for the applicant on the urgency application being I.A. No. 109/2023.
As per report of the Registrar dated 09.02.2023, the date is already fixed in the case for 11.04.2023, but it is stated in the urgency application that the court receiver has issued notice for taking physical possession of the secured asset on 04.03.2023 pursuant to the order dated 11.01.2023 passed by the CMM, New Delhi, therefore, it is prayed that the date already fixed in the case for 11.04.2023 may be preponed and the appellant may be granted an opportunity to take fresh steps for service of notice upon the respondents.
For the reason stated in the urgency application, the same is allowed and the date already fixed for 11.04.2023 is preponed to 03.03.2023 and the appellant is directed to take fresh steps within a week for service of notice upon the respondents by two modes i.e. Registered Post with A.D. and Speed Post. Affidavit of service along with tracking report be filed by the next date.
