No pre-deposit has been made by the appellant. A waiver Application being I.A No. 708/2022 has been filed stating that the appellants has deposited Rs. 7,86,48,741/- against the demand notice of Rs. 12,31,43,655.02 as mentioned in page 3 and 4 of Waiver Application and further stated that it is much more than 50% of the debts mentioned in the demand notice. The demand notice dated 26.07.2019 annexed with the appeal at page No. 33 shows the outstanding amount of Rs. 12,31,43,655.02.
The appellants has filed an Exemption Application being I.A. No. 709/2022 exempting them for filing the certified copy of impugned order annexed at page no. 29 of the appeal.
The appellants has also filed an Urgency Application being I.A. No. 707/2022 on the grounds that respondents Bank is rushing to take the physical possession of the secured asset after obtaining the order by the A.D.M. Ghaziabad.
The instant appeal has been filed under section 18 of the SARFAESI Act against the final order dated 01.08.2022 passed by DRT, Lucknow in S. A. No. 404/2021.
In view of the Urgency made out by the appellant let the case be placed before Hon’ble Chairperson on 23.12.2022 for admission.
