This application is for impleadment of the Applicant as Respondent, being the auction purchaser.

Heard the Learned Counsel for the parties and perused the record.

Learned Counsel for Applicant submits that the since the Applicant has purchased the property, i.e. the secured assets, on 12^th February, 2021, Applicant is a necessary party in the proceedings. Accordingly, I.A. 385 of 2022 is allowed.

Appellant is permitted to implead the Applicant/Intervenor as Respondent within a period of one week. Thereafter, the auction purchaser will be liberty to file

opposition within four weeks with copy to Respondent No. 1 and Appellant who may file rejoinder within two weeks thereafter.

In compliance of the order dated 31^st January, 2023, Mr. Gautam Das, Authorised Officer, is present and filed his personal affidavit; taken on record. Copy of the affidavit filed by M. Gautam Das be served upon Respondent No. 1.
