THE APPELLATE TRIBUNAL :

Heard the Learned Counsel for the Appellant. Appellant has not filed any objection against the I.A.
Objection filed by Respondent is taken on record. Copy of the objection is served upon Appellant today. Appellant may file rejoinder, if any, within two weeks.
Learned Counsel for Respondent submits that by an order, dated 26th February, 2021, Learned DRT-II, Kolkata has wherein the Bank was restrained from taking any further steps in respect of the said sale till the next date of hearing. This order was extended from time to time on different dates. Learned Counsel submits that despite this order, Bank received amount from the Auction Purchaser.
Appellant is hereby directed to explain as to why and under what circumstances amount was received despite the interim order dated 26th February, 2021, passed by the

Learned DRT-II, Kolkata. Appellant is directed to file personal affidavit of the concerned Authorised Officer explaining this aspect.
