THE APPELLATE TRIBUNAL :
Respondent No. 1 died on 11th December, 2020. Intimation to that effect was given in the year 2022 by the Learned Counsel for the Respondent. Thereafter application for substitution was moved as I.A. 318 of 2022 along with an application for condonation of delay in filing the substitution application, being I.A. 317 of 2022.
Learned Counsel for the Appellant submits that as soon as intimation was received, substitution application was filed and there was no intentional delay. I find the ground to be sufficient for condoning the delay. Accordingly delay is condoned. I.A. 317 of 2022 is allowed.
